Point Taken Terms of Use

Effective date: October 25, 2026

Last updated: October 25, 2026

These Terms of Use are entered into between you and ExperCeption LLC, which operates Point Taken ("ExperCeption," "we," "us," or "our"). These Terms govern the Point Taken website at pointtaken.social, the shared Point Taken account service, Point Taken online games, downloadable Point Taken materials, and any other Point Taken service that links to these Terms (collectively, the "Services"). "Point Taken" means the games, features, and services that ExperCeption now offers or later offers under the Point Taken name.

Please read these Terms carefully. By accessing or using the Services, you agree to these Terms. When a Service presents an "Agree and continue," "Agree and play," or similar control, selecting it means that you affirmatively agree to the version of these Terms then shown or linked. Some features and downloads may require separate acceptance or an additional notice before use. If you do not agree, do not use the Services.

Our Privacy Policy describes how we handle personal information, including game submissions, chat, voice transcription, internal product improvement, retention, and deletion. The Privacy Policy is a notice and is not a substitute for any consent that applicable law separately requires.

1. Eligibility and age

You must be at least 13 years old to use an online Point Taken game or its social features. Children under 13 may not create an account, play an online game, participate in chat, or otherwise submit personal information through the interactive Services.

If you are at least 13 but have not reached the age of legal majority where you live, you may use the interactive Services only with permission from your parent or legal guardian. You represent that your parent or legal guardian has reviewed these Terms and authorized your use. We expect a parent or legal guardian who permits a minor to use the Services to supervise that use.

A Service may ask you to select or confirm an age or age band. When asked, you must answer truthfully and correct an inaccurate answer. An age answer is a user statement, not independent age or identity verification. We may restrict access when an answer is missing, inconsistent, or reasonably appears to be false.

Unless a feature expressly supports an invited interaction among people who know one another, you may use stranger matching or stranger communication only if you are at least 18. Point Taken does not currently collect an age band from every user or independently verify age, so this restriction relies on your truthful compliance and any age statement a feature requests. If we learn a user is under 18, we will restrict that user's access to stranger features. We will not offer stranger matching designed for users aged 13 through 17 until the feature provides an age-band path that keeps stranger matching within the same band. Because age information relies on user statements, we cannot guarantee another person's identity or age.

A feature may permit an invited interaction among known people or family members of different ages where the interface expressly supports it. Each participant must understand who is participating, and a participant under the age of legal majority must have permission from a parent or legal guardian. An invitation does not override any feature restriction or applicable law.

If you are under 18 and you or your parent or guardian disaffirm these Terms where applicable law permits, you must stop using the Services. To the extent applicable law permits, continued use after you reach 18 may confirm your agreement to these Terms. Content submitted and information processed before a valid disaffirmance may be retained and used only as these Terms, the Privacy Policy, and applicable law permit. Nothing in this paragraph limits a non-waivable right.

Printable Point Taken materials are separate from the interactive Services. Any license or age guidance presented with a download governs use of those materials.

Ordinary consumer use by a student does not authorize a school or other organization to deploy the Services institutionally, collect student information through them, or represent that ExperCeption approved the deployment. A formal school or organizational deployment may require separate written terms and authorization.

2. Accounts and account security

You may need an account to use some Services. You agree to provide accurate, current, and complete account information and to keep it current. Your account is personal to you. Do not share credentials or allow another person to use your account.

You are responsible for activity under your account unless applicable law provides otherwise. Notify us promptly at info@experception.com if you believe your account has been used without authorization.

We may restrict or disable an account when reasonably necessary to protect the Services or other users, investigate suspected misuse, comply with law, or enforce these Terms.

3. Game submissions and shared interactions

The Services may allow players to submit or select display names, avatars, topics, preferences, stances, arguments, submitted revisions, messages, reports, and other content. Some information is visible to opponents, conversation partners, or other signed-in users as described in the Privacy Policy and the interface.

Game records may preserve the history and integrity of a shared match. If one participant deletes an account, that participant's contributions may remain in another participant's shared game or chat record so that the other participant's history is not rewritten. Shared text may itself contain identifying information and is not necessarily anonymous merely because account or profile information is removed or limited. The Privacy Policy describes current deletion and retention practices.

Scores, feedback, matches, and automated outputs are game features. They are not professional advice, factual determinations, psychological assessments, or judgments about a person's character.

4. Chat and communication

Some Services may offer text or transcribed conversation between matched or invited participants. Chat may be limited to a match, room, or defined period. Point Taken is not an open direct-message network, and the availability, duration, and controls for a conversation may differ by feature or change over time.

A participant may leave, block another participant, or report content when those controls are available. Blocking is designed to stop new contact through the applicable feature, but it does not erase a shared game record or evidence preserved for a report.

Chat is not confidential, privileged, or continuously monitored. The other participant can read what you send. ExperCeption and its service providers may process submitted chat, including through human review by authorized personnel, to deliver and secure the feature, investigate reports, and identify or repair technical errors. When the notices and controls described in Section 6 apply, they may also internally analyze, develop, and improve Point Taken. Closing or expiring a room ends participant access through that feature; it does not necessarily cause immediate deletion from operational, safety, backup, or internal-improvement systems. The Privacy Policy describes applicable retention.

We strongly recommend that you do not share private contact information, precise location, financial information, health information, passwords, or other information that you do not want the other participant or ExperCeption to have. Do not ask another user, including a user who may be a minor, for sexual or romantic interaction, money, precise location, private contact information, or off-platform contact.

An optional AI feature may appear in a conversation. The interface will identify an automated feature where appropriate. It may generate incomplete, inaccurate, biased, or inappropriate output. It is not a human moderator, therapist, fact-checker, or emergency service.

We may use automated tools to detect or limit suspected abuse, but we do not promise to screen every message, prevent every harmful interaction, continuously monitor conversations, or review every report immediately. If you believe someone faces imminent danger, contact the appropriate emergency service rather than relying on Point Taken.

5. Microphone and transcription features

When a Service offers microphone or speech-to-text features, review the transcription notice and the controls shown for that feature before activation. By activating the feature, you authorize the Service and its transcription provider to process speech for the disclosed feature. A deliberately submitted transcript is treated like other submitted content under these Terms.

You may activate transcription only when every person whose private conversation may be captured has been informed that transcription is active and has agreed to it. If another person substantively joins the conversation, you must inform that person and obtain agreement before continuing. Do not intentionally capture a private conversation in secret. Incidental or distant background speech in a public setting does not by itself require you to stop, but you must not intentionally capture or submit it as another person's content. This restriction does not prevent capture of speech from another participant who completed the applicable transcription acknowledgement for the same room or session. That acknowledgement authorizes only the disclosed feature and does not eliminate obligations imposed by applicable law.

You are responsible for using microphone and transcription features in compliance with applicable recording, interception, privacy, and consent laws. The Services are not designed as an audio-recording or surveillance tool. Raw microphone audio is streamed directly from the browser to the transcription provider for real-time processing. Point Taken servers do not receive or store raw microphone audio. Transcript text is handled as described in the Privacy Policy and the interface.

6. Your content and internal Point Taken improvement

You retain any ownership rights you have in content you submit to the Services. You grant ExperCeption a non-exclusive, worldwide, royalty-free license, with the limited right to sublicense to service providers acting on our behalf, to host, store, reproduce, process, analyze, annotate, modify, display, transmit, and otherwise use submitted content, including submitted game content and chat, for the following purposes:

The new pseudonymous improvement program applies prospectively. For users aged 18 or older, it applies to content submitted after that program is enabled and only when the applicable feature has provided notice of the improvement use and the restricted identity-linkage controls described in the Privacy Policy are operating. Content collected under an earlier notice that prohibited or did not disclose improvement use is not included unless you later authorize that use. Existing account-linked quality-assurance records are described separately in the Privacy Policy; new optional collection into that legacy dataset is paused. These Terms do not retroactively expand the purposes for which existing records may be processed.

For a user whom ExperCeption knows to be aged 13 through 17, submitted content may be used for optional internal Point Taken improvement only with that user's separate, informed consent. We apply any broader protections required by applicable law, including protections for services directed to minors. Until a compliant consent flow is available, no such optional use is authorized. Accepting these Terms does not provide that consent, and declining it does not prevent ordinary use of the Service. Consent may be withdrawn through the control provided with the request or by contacting us. We then stop the optional processing and delete the associated person-level improvement records unless another lawful retention ground applies. Withdrawal does not require ExperCeption to undo aggregate measures or improvements already created that do not reproduce the content or reasonably permit identification, except where applicable law requires otherwise.

Before submitted content enters the new pseudonymous improvement program described in the Privacy Policy, ExperCeption will separate the email address and ordinary account identifier from that content and assign a random analysis identifier. ExperCeption may maintain a separately protected linkage for deletion, account administration, safety, reporting, bans, and other controlled purposes described in the Privacy Policy. This is pseudonymization, not anonymization. Separation of account identifiers applies to account fields that ExperCeption controls. Submitted content may itself contain names, contact details, or other identifying information, and we do not guarantee that every identifying detail within submitted content will be detected or removed.

ExperCeption may sublicense only the rights reasonably required for approved service providers acting on ExperCeption's behalf to operate, secure, maintain, and improve Point Taken for the purposes listed above, including related evaluation services where disclosed. Those providers remain subject to applicable contractual and use restrictions. This license does not authorize ExperCeption or a provider to sell or license submitted content as a standalone dataset, publish identifiable user content, train a general-purpose or unrelated model, use content for academic or IRB research, or use content to improve a provider's own models. A materially different external use would require a separate decision, updated disclosure, and consent or other authorization where applicable.

The license lasts while content is retained under the Privacy Policy. A limited license may survive deletion to preserve and display contributions in another participant's shared game or chat record and to maintain a report record, backup, legal hold, or other lawful exception described in the Privacy Policy.

Deletion does not require ExperCeption to reverse or discard nonidentifying Point Taken model outputs, prompt configurations, evaluations, safety rules, aggregate statistics, or other improvements created before deletion, but only if those artifacts do not reproduce your content and do not reasonably permit reidentification of you or your content.

You represent that you have the rights and permissions needed to submit your content and grant this license. Do not submit content that violates another person's intellectual property, privacy, publicity, recording, confidentiality, or other rights.

7. AI and automated features

Some Services use automated systems supplied by third-party providers to generate an AI opponent, provide coaching or a chat guide, evaluate game structure, transcribe speech, or help identify potentially abusive content. Point Taken may send the provider the game, chat, audio, or other context reasonably needed for the feature, as described in the Privacy Policy.

AI output can be wrong, incomplete, biased, or inappropriate. Do not rely on it as legal, medical, financial, mental-health, safety, or other professional advice. AI output does not represent ExperCeption's views and does not change the official game record unless a Service expressly says that an authorized game action occurred.

8. Conduct and prohibited uses

You must follow the conduct commitments shown before play and use the Services lawfully. You may not:

9. Reports, blocking, and enforcement

Players may report or block other players using available controls. A report may include the reported material and limited surrounding context needed to understand it.

ExperCeption may investigate reports and may remove content from player-facing views, close a conversation, restrict features, suspend or terminate access, preserve relevant evidence, or refer a matter to authorities when it reasonably believes these Terms or applicable law may have been violated. ExperCeption may use account identifiers and safety records to enforce restrictions and prevent ban evasion. We do not promise a particular response, outcome, or response time for every report.

10. ExperCeption content and intellectual property

The Services and their software, designs, graphics, text, audio, video, game systems, branding, and other content supplied by ExperCeption or its licensors are protected by intellectual-property laws. Except for a limited license expressly granted by these Terms or with particular materials, ExperCeption and its licensors reserve all rights.

You may use the online Services only for their intended personal or authorized organizational purpose. You may not reproduce, publish, distribute, sell, sublicense, create derivative works from, or commercially exploit ExperCeption content without written permission.

The names ExperCeption, Point Taken, and associated names, logos, designs, and slogans are trademarks of ExperCeption or its licensors. No trademark license is granted.

11. Downloadable Point Taken materials

Unless a different license is displayed with a download, ExperCeption grants you a limited, non-exclusive, non-transferable, revocable license to download and use a Point Taken PDF game packet for 30 days for personal, non-commercial use. You may print a reasonable number of copies needed for that authorized use.

You may not post or upload the digital packet to a public or shared location; sell, rent, sublicense, or distribute the digital packet; use it for paid workshops, commercial training, or resale; remove rights notices; or retain it after the license period. A separate written or download-page license may permit classroom, organizational, or commercial use on different terms.

12. Third-party services and links

The Services may use or link to third-party services. Third parties may apply their own terms and privacy practices. ExperCeption does not control third-party sites and is not responsible for their content, availability, or practices.

13. Retention, changes, availability, and termination

The Privacy Policy describes current retention and deletion practices for account information, submitted game content, chat, voice transcription, reports, safety records, logs, backups, and internal-improvement information. Retention differs by data type, feature, and purpose.

We may add, change, suspend, or discontinue a Service or feature. We may revise these Terms. The updated version will state its effective date. If a change materially affects registered users, we will provide notice through the Service or using available contact information and will request renewed acceptance when appropriate.

You may stop using the Services at any time. You may request account deletion through available account controls or by contacting us. Sections that by their nature should survive termination, including intellectual-property, warranty, liability, dispute, enforcement, and limited-retention provisions, will survive.

14. Geographic availability

ExperCeption is based in Illinois, United States. The Services are designed and primarily marketed for use in the United States. We do not actively target or specifically market the interactive Services to people outside the United States. Incidental access from another country may be technically available, but we do not represent that the Services are appropriate or lawful in every location. If you access a Service from outside the United States, you are responsible for complying with applicable local law, and mandatory rights under applicable law are not waived by these Terms.

15. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXPERCEPTION AND ITS SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES, AI OUTPUT, GAME CONTENT, CHAT, TRANSCRIPTION, OR OTHER MATERIAL WILL BE ACCURATE, COMPLETE, SAFE, SECURE, UNINTERRUPTED, OR ERROR-FREE, OR THAT EVERY DEFECT OR HARMFUL COMMUNICATION WILL BE DETECTED OR CORRECTED. WE DO NOT GUARANTEE ANOTHER USER'S IDENTITY, AGE, INTENTIONS, OR CONDUCT.

Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXPERCEPTION, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF EXPERCEPTION AND THE OTHER PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID EXPERCEPTION FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ExperCeption, its affiliates, licensors, service providers, and their respective officers, directors, employees, and agents from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees to the extent caused by your unlawful content, your unlawful use of the Services, your unlawful recording or transcription of another person, or your material violation of these Terms. ExperCeption will provide reasonable notice of a covered claim and may control its defense and settlement. You may not settle a claim in a way that admits liability by or imposes an obligation on ExperCeption without ExperCeption's written consent.

18. Governing law and venue

Illinois law governs these Terms and disputes relating to them, without regard to conflict-of-law principles. Any legal action arising from these Terms or the Services must be brought in the state courts located in Cook County, Illinois, or the United States District Court for the Northern District of Illinois, unless applicable law gives you a non-waivable right to another forum.

ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES MUST BE FILED WITHIN ONE YEAR AFTER IT ACCRUES, UNLESS APPLICABLE LAW DOES NOT PERMIT THAT LIMITATION.

19. General terms

These Terms and any feature-specific terms presented with a Service form the entire agreement between you and ExperCeption concerning the Services. If feature-specific terms conflict with these Terms, the feature-specific terms control for that feature. If these Terms and the Privacy Policy conflict regarding the handling of personal information, the Privacy Policy controls.

If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. ExperCeption may transfer them as part of a merger, reorganization, sale, or other lawful business transaction.
